1. Acceptance of Terms
By accessing or using agemanagement.com or myfinancialplanner.biz (the "Site(s)"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site.
2. Operator
The Site is operated by AGE Management, Abilene Texas. You may contact us at admin@agemanagement.com .
3. Purpose of the Site
The Site provides retirement planning, budgeting, projection, cash flow, savings, tax-estimate, and scenario modeling tools for informational and educational purposes. The Site is intended to help users organize information and view planning projections.
4. No Financial, Tax, Legal, or Investment Advice
The Site does not provide personalized financial planning, tax advice, legal advice, accounting advice, investment advice, or fiduciary services unless separately stated in a written engagement agreement signed by both parties. Outputs, projections, estimates, and recommendations generated by the Site are illustrative only and may be based on assumptions, incomplete information, or simplified models. Users remain solely responsible for decisions made based on Site content or output.
5. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a binding agreement to use the Site. You are responsible for maintaining the confidentiality of your login credentials, for all activity under your account, and for promptly notifying us of suspected unauthorized access.
6. Account Security
You agree to provide accurate registration information, maintain a secure password, and use available account security features such as email verification and two-factor authentication where offered. We may suspend or terminate access if we reasonably believe your account has been compromised or used in violation of these Terms.
7. User Content and Data
You retain ownership of the information, files, assumptions, scenarios, workbook imports, and other content you submit to the Site ("User Content"). You grant us a limited license to host, process, store, transmit, back up, and display User Content as reasonably necessary to operate, secure, maintain, and improve the Site.
8. Acceptable Use
You agree not to: (a) use the Site for unlawful purposes; (b) attempt unauthorized access to accounts, systems, or data; (c) interfere with Site operation or security; (d) upload malicious code; (e) scrape or copy the Site at scale without permission; (f) use the Site to infringe the rights of others; or (g) misrepresent your identity or authority.
9. Data Accuracy and Assumptions
The accuracy of Site output depends on the quality and completeness of the information entered by the user. Market prices, tax assumptions, retirement projections, withdrawal recommendations, and other planning outputs may be delayed, incomplete, or inaccurate. Users must independently review important assumptions and outcomes.
10. Availability and Changes
We may change, suspend, or discontinue any part of the Site at any time, with or without notice. We do not guarantee uninterrupted availability, error-free operation, or that the Site will meet every user need.
11. Backups and User Responsibility
The Site may offer export, backup, restore, scenario versioning, or safety snapshot features. These tools are helpful but are not a substitute for your own recordkeeping. You are responsible for maintaining copies of critical records and confirming restored data before relying on it.
12. Intellectual Property
The Site, including its software, design, text, graphics, layout, branding, and non-user content, is owned by or licensed to AGE Management and is protected by applicable intellectual property laws. Except as expressly permitted, you may not reproduce, distribute, modify, reverse engineer, or create derivative works from the Site.
13. Third-Party Services
The Site may rely on third-party services such as hosting providers, email delivery providers, SMS delivery providers, market data providers, analytics providers, or payment processors. We are not responsible for third-party services, websites, or content except as required by law.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RESULTS.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGE MANAGEMENT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, INVESTMENT VALUE, TAX POSITION, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATING TO THE SITE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR USE OF THE SITE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100.
16. Indemnification
You agree to indemnify and hold harmless AGE Management and its owners, officers, employees, contractors, and affiliates from claims, liabilities, damages, judgments, losses, and expenses arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
17. Suspension and Termination
We may suspend, restrict, or terminate your access at any time if we believe you have violated these Terms, created risk to the Site or other users, or if continued access is not commercially or legally practical.
18. Governing Law and Venue
These Terms are governed by the laws of Texas, without regard to conflict of laws rules. Any dispute arising from or relating to these Terms or the Site shall be brought exclusively in the courts located in Taylor County, Texas, unless applicable law requires otherwise.
19. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a revised effective date. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
